Field2Fare Terms of Service

Welcome to Field2Fare! These Terms of Service ("Terms") govern your access to and use of the Field2Fare website, mobile applications, and services (collectively, the "Platform"). Please read these Terms carefully. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
1. The Field2Fare Platform
Field2Fare is a two-sided online marketplace that connects local farmers, artisans, and agricultural producers ("Producers") with consumers seeking local goods and farm experiences ("Explorers").
- We Are a Venue: Field2Fare does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any of the agricultural products, farm stands, or experiences listed on the Platform. Producers alone are responsible for their listings and goods.
- Offline Interactions: When you interact with other Members offline (e.g., visiting a farm stand), you do so at your own risk. Field2Fare is not responsible for the safety, quality, or legality of the physical premises or the goods sold.
2. Account Registration & Third-Party Authentication
To access certain features, you must register for an account.
- Accuracy: You must provide accurate, current, and complete information during registration.
- Third-Party Logins (SSO): You may register using third-party accounts (e.g., Apple, Google, Facebook). By doing so, you authorize Field2Fare to access and use certain account information from those third parties as permitted by your privacy settings with them. Field2Fare is not responsible for the uptime or data practices of these third-party identity providers.
3. Communications & Twilio (SMS) Compliance
By creating an account, you consent to receive electronic communications from Field2Fare and other users.
- SMS & Text Messages: By providing your phone number, you expressly consent to receive informational and transactional SMS/text messages from Field2Fare (powered by Twilio or similar providers) regarding account verification, visit requests, and platform updates.
- Opting Out: You may opt-out of receiving text messages at any time by replying "STOP" to our messages or adjusting your account settings. Standard message and data rates may apply.
4. Terms for Producers (Farmers)
If you list a stand or products on Field2Fare, you agree to the following:
- Accuracy of Listings: You are responsible for ensuring your hours, location, product availability, and prices are accurate and up-to-date.
- Compliance with Laws: You represent and warrant that you hold all necessary licenses, permits, and certifications required to sell your agricultural or food products under local, state, and federal law.
- Taxes: You are solely responsible for determining your obligations to report, collect, remit, or include in your prices any applicable VAT or other indirect sales taxes.
5. Terms for Explorers (Consumers)
As a consumer using the platform, you agree to:
- Respectful Conduct: You will behave respectfully and legally when visiting a Producer's physical property.
- Assumption of Risk: Visiting working farms and agricultural properties involves inherent risks (e.g., uneven terrain, animals, farm equipment). You assume all risks associated with visiting these locations.
6. Payments and Fees
- Platform Fees: Field2Fare may charge fees to Producers and/or Explorers for use of the Platform (e.g., premium features, transaction fees). Any applicable fees will be clearly disclosed prior to purchase.
- Payment Processing: Payment processing services are provided by third-party processors (e.g., Stripe) and are subject to their respective terms of service. Field2Fare does not store your full credit card information.
7. App Store & Google Play Specific Terms
If you access the Platform via a mobile application downloaded from the Apple App Store or Google Play Store, the following applies:
- Acknowledgment: These Terms are concluded between you and Field2Fare only, not with Apple Inc. or Google LLC. Field2Fare is solely responsible for the App and its content.
- Maintenance & Support: Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you.
8. Content, Acceptable Use, & UGC
- Your Content: You retain ownership of any text, photos, messages, or reviews you upload to the Platform. By uploading, you grant Field2Fare a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content to operate and promote the Platform.
- Zero Tolerance for Objectionable Content: Field2Fare maintains a strict, zero-tolerance policy regarding objectionable user-generated content (UGC) and abusive behavior. You agree not to upload, post, or transmit any content that is offensive, discriminatory, harassing, defamatory, obscene, or illegal.
- Account Termination: We reserve the right to review, remove, or delete any content and to immediately suspend or permanently terminate the accounts of users who violate these guidelines without prior notice.
- Field2Fare IP: The Field2Fare name, logo, and platform code are the intellectual property of Field2Fare LLC. You may not use them without permission.
9. Disclaimers
The Platform is provided "as is" and "as available." Field2Fare disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Field2Fare does not warrant that the Platform will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Field2Fare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; or (c) any offline interactions with other Members.
11. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration in Wisconsin, rather than in court, except that you may assert claims in small claims court if your claims qualify.
